Public Offer Agreement

This public offer agreement is open and available to the public. In accordance with Article 633 of the Civil Code of Ukraine, its terms are the same for all buyers regardless of their status (individual, legal entity, or individual entrepreneur). By fully agreeing to this Agreement, the Buyer accepts the terms and procedure for placing an order, paying for goods, receiving goods, and the responsibilities in case of non-compliance with the terms of this Agreement.

This text constitutes an agreement between the online store https://33pharma.com (hereinafter referred to as the “Online Store”) and the user of the Online Store’s services (hereinafter referred to as the “Buyer”) and defines the terms of purchasing goods through the Online Store website.

1. General Provisions

1.1. This agreement is a public offer (in accordance with Articles 633, 641, and Chapter 63 of the Civil Code of Ukraine) and includes all essential conditions for remote sales, i.e., via an online store.

1.2. By accepting the terms of this public offer from the Online Store, the citizen or legal entity who accepts the offer becomes the Buyer. Acceptance is confirmed by placing an order via the “Place an order” link in the shopping cart and paying 100% of the total amount under the terms of this Agreement.

2. Terms and Definitions

2.1. “Product” – the items listed and available for sale in the Online Store.

2.2. “Catalog” – information about products published in the Online Store.

2.3. “Place an order” – the Buyer’s action to purchase a product listed in the Online Store.

3. Subject of the Agreement

3.1. The Online Store agrees to transfer ownership of the goods to the Buyer, and the Buyer agrees to pay for and accept the goods under the terms of this Agreement.

3.2. This Agreement governs the sale process in the Online Store, including:

  • a) voluntary selection of goods by the Buyer from the Catalog;
  • b) independent placement of an order in the Online Store;
  • c) payment for the order by the Buyer;
  • d) fulfillment and transfer of the order to the Buyer under the terms of this Agreement.
4. Ordering Procedure

4.1. The Buyer places an order independently in the Online Store.

5. Cost and Payment Procedure

5.1. The total order cost includes the price of the goods (as listed in the Catalog) and delivery fees.

5.2.1. The Buyer pays for the order using one of the available payment methods (“Bank card, PayPal, Western Union, MoneyGram, or Crypto Cloud”) within 3 business days from the date of agreement on the cost and item list, with 100% prepayment.

5.2.2. For “Cash on Delivery,” payment is made within 3 business days from the date of delivery to the address specified by the recipient.

5.3. Delivery fees are paid by the Buyer upon receipt and are determined by the carrier's (third-party) tariffs.

6. Order Delivery

6.1. Total delivery time includes order processing (1–3 business days) and transportation. Delivery methods are detailed in the “Delivery and Payment” section of the website. Delivery time depends on the shipping method and destination address.

6.2. For wholesale orders, delivery times and methods are agreed upon separately in each case.

6.3. The Seller is not responsible for delivery delays caused by third parties (carriers).

7. Return Policy

7.1. The Buyer may return defective goods within 14 days of receipt, provided the packaging, appearance, and consumer qualities are intact. The Buyer must review the return and exchange rules at: https://33pharma.com/oferta.

7.2. If the Buyer refuses the parcel, it is returned to the Online Store. Return shipping is paid by the Online Store.

7.3. 33Pharma Online Store accepts returns of unused items that show no signs of use (scratches, chips, wear) and have passed service center checks.

If the Buyer returns a wholesale batch of goods not eligible for return, the cost will be refunded minus all transport expenses and a 30% restocking fee.

For retail returns, the Buyer will receive a refund excluding shipping costs.

8. Rights and Obligations of the Parties

8.1. The Buyer is obliged to:

  • a) place orders independently in the Online Store;
  • b) pay for and receive the order from the carrier in a timely manner under this Agreement.

8.2. The Buyer has the right to require the Online Store to comply with this Agreement.

8.3. The Online Store is obliged to:

  • a) fulfill the terms of this Agreement;
  • b) deliver goods matching the Buyer’s order and selections from the Catalog;
  • c) not be held liable for, or required to compensate for, any losses due to the actions or inactions of third parties.
9. Duration of the Agreement

9.1. This Agreement takes effect upon payment and remains valid until all obligations are fulfilled.
